If any dog within the city is determined by the county health officer to be vicious or dangerous to the safety of any person or persons, or if any such dog is known to have bitten any person or persons on at least three separate occasions as evidenced by affidavits furnished to the county health officer, the health officer shall notify the owner or person having control of such dog to keep the dog in such manner as the health officer shall direct. If it is determined by the county health officer that such dog cannot be properly controlled by the owner or person having custody and no further arrangements can be made to ensure public safety, then the county health officer shall direct the city poundmaster to destroy such dog.
